Welcome to Golf Flyers Limited! As you embark on an exciting golfing adventure with us, it’s essential to grasp the nature of our offerings. The travel arrangements showcased on our website and in our brochures are provided by third parties known as “Supplier Principal(s).” Golf Flyers Limited acts as an agent for these Supplier Principals, who are solely responsible for delivering the travel arrangements you choose to book. Please be aware that Golf Flyers Limited neither owns, controls, nor operates these Supplier Principals or the various elements of your travel experience. Unless explicitly stated otherwise, all travel arrangements presented on our platform are sold by us as an agent for the actual Supplier Principals, underscoring our role as an intermediary facilitating your journey. If, however, we specify that the travel arrangements are sold by us as a principal, it will be expressly indicated.

1. Booking and Payment:

1.1. To secure a reservation for a golf tour with Golf Flyers Limited, a non-refundable deposit of £100 per person is required at the time of booking. Failure to pay the deposit within 7 days may result in the cancellation of the participant’s reservation.

1.2. Full payment must be received by Golf Flyers Limited no later than 12 weeks before the tour start date. Accepted payment method is a bank transfer. All prices are quoted in GBP. Participants are responsible for any additional bank charges or transaction fees incurred during the payment process.

2. Booking Confirmations:

2.1. Upon successful completion of the booking process and receipt of the non-refundable deposit, participants will receive a booking confirmation via email.

2.2. The booking confirmation will include essential details such as the participant’s name, tour dates, accommodation details, and a summary of payments made. Participants must review the confirmation for accuracy and promptly notify Golf Flyers Limited of any discrepancies.

3. Data Protection and Privacy:

3.1. Golf Flyers Limited is committed to protecting the privacy and personal information of participants.

3.2. The personal information provided by participants during the booking process will be used solely for the purpose of managing the tour and providing relevant information.

3.3. Golf Flyers Limited will not share, sell, or disclose participants’ personal information to third parties unless required by law or with explicit consent.

3.4. Participants have the right to access, modify, or request the deletion of their personal information held by Golf Flyers Limited. Requests can be made in writing to info@golf-flyers.com.

4. Cancellations and Refunds:

4.1. Individual cancellations made 56 or more days before the tour start date are eligible for a partial refund, excluding the non-refundable deposit. This may vary depending on the local hotel policy.

4.2. No refunds will be issued for cancellations made less than 55 days before the tour start date.

4.3. Golf Flyers Limited reserves the right to cancel a tour due to unforeseen circumstances such as insufficient bookings, adverse weather conditions, or other unavoidable situations. In such cases, a full refund will be provided to participants.

4.4. Group cancellations made 84 or more days before the tour start date are eligible for a partial refund, excluding the non-refundable deposit. 

4.5. No refunds will be issued for group cancellations made less than 83 days before the tour start date.

5. Changes to the Tour Itinerary:

5.1. Golf Flyers Limited reserves the right to make changes to the tour itinerary, including alterations to golf course locations, accommodations, and scheduled activities. Participants will be promptly notified of any significant changes, and every effort will be made to provide suitable alternatives.

5.2. While every effort is made to adhere to the planned itinerary, Golf Flyers Limited may need to make adjustments due to circumstances beyond its control, including but not limited to weather conditions, natural disasters, or unavailability of specified golf courses.

5.3. Participants acknowledge that variations may occur, and Golf Flyers Limited will strive to maintain the overall quality and experience of the tour.

6. Participant Responsibilities:

6.1. Participants are responsible for obtaining and ensuring the validity of all necessary travel documents, including passports, visas, and any required health certificates.

6.2. Participants must comply with all local laws and regulations during the tour and are advised to familiarize themselves with the rules and etiquette of each golf course on the itinerary.

6.3. It is the responsibility of participants to secure comprehensive travel insurance covering personal injury, medical emergencies, trip cancellations, and loss or damage to personal belongings.

7. Dress Code Policy on Golf Courses:

7.1. Participants are required to adhere to the dress code policies of each golf course on the tour itinerary.

7.2. The standard golf attire, including collared shirts, tailored shorts or pants, and golf shoes, must be worn while on the golf course.

7.3. Denim, athletic shorts, beachwear, and metal spikes are generally not permitted on most golf courses. Participants should familiarize themselves with the specific dress code of each course in advance.

7.4. Failure to comply with the dress code may result in the participant being denied access to the golf course. Golf Flyers Limited is not responsible for any such denial of access, and no refunds will be provided in such cases.

8. Obtaining Insurance Cover:

8.1. Golf Flyers Limited strongly recommends that all participants obtain comprehensive travel insurance for the duration of the tour.

8.2. Travel insurance should cover personal injury, medical emergencies, trip cancellations, and loss or damage to personal belongings.

8.3. Participants are responsible for ensuring that their insurance policy provides adequate coverage for the activities included in the golf tour.

8.4. Golf Flyers Limited is not liable for any expenses, losses, or damages incurred by participants that could have been covered by adequate travel insurance.

9. FCDO (Foreign, Commonwealth & Development Office) Guidance:

9.1. Participants are advised to regularly check the FCDO website (www.gov.uk/foreign-travel-advice) for the latest travel advice and updates regarding the destinations included in the golf tour.

9.2. Golf Flyers Limited reserves the right to modify or cancel the tour if there are travel restrictions, warnings, or advisories issued by the FCDO that may affect the safety and feasibility of the tour.

9.3. In the event of changes due to FCDO guidance, Golf Flyers Limited will make reasonable efforts to provide alternative arrangements or reschedule the tour. If this is not possible, a prorated refund will be issued, taking into account incurred expenses.

10. Changes by Customer:

10.1. Participants may request changes to their booking, 28 or more days before the tour start date to their booking, including tour dates, accommodation preferences, or other relevant details.

10.2. Golf Flyers Limited will make reasonable efforts to accommodate change requests, subject to availability and any additional costs incurred.

10.3. Changes requested by participants within 27 or less days before the tour start date may not be possible, and Golf Flyers Limited reserves the right to deny such requests. 

11. Pricing / Price Changes, Taxes/Local Charges, and Resort Fees:

11.1. The prices quoted for Golf Flyers Limited’s tours are based on current exchange rates, accommodation costs, transportation charges, and other relevant factors.

11.2. Golf Flyers Limited reserves the right to adjust tour prices in the event of significant changes in exchange rates, government taxes, or other factors beyond its control.

11.3. Participants will be notified of any price changes as soon as possible, and they have the option to either accept the new pricing or cancel their reservation with a full refund of payments made.

11.4. Taxes, local charges, and resort fees may not be included in the initial tour price and are the responsibility of the participant. These additional charges, if applicable, will be communicated to participants during the booking process or before the tour start date.

11.5. Participants are advised to inquire about any potential taxes, local charges, or resort fees associated with the tour and seek clarification from Golf Flyers Limited if needed.

11.6. Golf Flyers Limited will strive to provide transparent information regarding additional charges, but participants are responsible for staying informed about any updated or additional fees associated with the tour.

12. Excursions Agreed and Paid for Locally:

12.1. Excursions, additional activities, or services not explicitly included in the tour package but agreed upon locally may be available at the participant’s request.

12.2. Participants are responsible for the payment of such locally agreed-upon excursions or services directly to the relevant service providers.

12.3. Golf Flyers Limited is not liable for the quality, availability, or any issues related to excursions or services arranged and paid for locally.

13. Accuracy of Information on Website and Brochures:

13.1. Golf Flyers Limited strives to provide accurate and up-to-date information on its website, brochures, and promotional materials.

13.2. While every effort is made to ensure the accuracy of information, Golf Flyers Limited reserves the right to make changes to tour details, including pricing, itineraries, and inclusions, without prior notice.

13.3. Participants acknowledge that variations may occur, and Golf Flyers Limited is not liable for any discrepancies between the information provided on the website, brochures, or promotional materials and the actual tour experience.

14. Liability:

14.1. Golf Flyers Limited accepts liability for direct losses arising solely from its negligence in the provision of services related to the tour. However, Golf Flyers Limited is not liable for indirect or consequential losses.

14.2. Golf Flyers Limited’s total liability is limited to the total amount paid by the participant for the tour.

14.3. Golf Flyers Limited is not liable for losses or damages arising from the participant’s failure to comply with these terms and conditions, including but not limited to obtaining necessary travel documents, complying with local laws, and adhering to golf course policies.

14.4. Participants are strongly advised to obtain adequate travel insurance to cover potential losses or damages beyond the scope of Golf Flyers Limited’s liability.

14.5. Golf Flyers Limited is not liable for losses resulting from flight delays or cancellations, and participants are encouraged to secure travel insurance that covers such situations.

15. Medical Issues:

15.1. Participants are responsible for disclosing any pre-existing medical conditions, allergies, or other health-related concerns to Golf Flyers Limited during the booking process.

15.2. Golf Flyers Limited may require participants to provide a medical certificate or other documentation confirming their fitness to participate in the golf tour.

15.3. Participants with known medical conditions should carry necessary medications and inform the tour guide or accompanying staff about their condition in case of emergencies.

15.4. Golf Flyers Limited is not liable for any medical issues, injuries, or complications that arise during the tour. Participants are advised to secure comprehensive travel insurance covering medical emergencies.

16. COVID-19:

16.1. Participants acknowledge and understand the risks associated with travel, including the potential exposure to COVID-19.

16.2. Golf Flyers Limited will adhere to all relevant health and safety guidelines provided by local authorities and health organizations.

16.3. Participants may be required to undergo health screenings, provide proof of vaccination, or comply with other COVID-19 related protocols as mandated by the destinations visited.

16.4. Golf Flyers Limited reserves the right to implement changes to the tour itinerary, accommodations, or activities to ensure the safety and well-being of participants.

16.5. In the event of COVID-19 related disruptions, Golf Flyers Limited will make reasonable efforts to provide alternative arrangements or reschedule the tour. If this is not possible, a prorated refund will be issued, taking into account incurred expenses.

17. Code of Conduct:

17.1. Participants are expected to conduct themselves in a manner that is respectful, considerate, and in adherence to local customs and regulations.

17.2. Disruptive, disrespectful, or inappropriate behaviour, including but not limited to harassment, intoxication, or vandalism, will not be tolerated.

17.3. Golf Flyers Limited reserves the right to address behavioural issues with appropriate measures, including warnings, fines, or expulsion from the tour, without any refund.

18. Force Majeure:

18.1. Golf Flyers Limited is not liable for any failure or delay in performance resulting from acts beyond its control, including but not limited to natural disasters, government actions, strikes, civil disturbances, or other unforeseen circumstances.

18.2. In the event of force majeure, Golf Flyers Limited will make reasonable efforts to provide alternative arrangements or reschedule the tour. If this is not possible, a prorated refund will be issued, taking into account incurred expenses.

19. Special Requests:

19.1. Participants may submit special requests, including dietary restrictions, room preferences, or any other reasonable requests, during the booking process.

19.2. Golf Flyers Limited will make reasonable efforts to accommodate special requests, including the provision of buggies if requested, but cannot guarantee their fulfilment. Failure to meet a special request does not constitute a breach of contract, and participants understand that such requests are subject to availability and the discretion of service providers.

20. Buggies:

20.1. Buggy requests for golf courses can be submitted during the booking process or within 28 or more days before the tour start date.

20.2. Golf Flyers Limited will make reasonable efforts to arrange buggies for participants who request them, subject to availability at the respective golf courses.

20.3. The availability of buggies is at the discretion of the golf courses, and Golf Flyers Limited is not responsible for any denial of buggy access by the golf courses. No refunds will be provided in such cases.

21. Valid Travel Documentation:

21.1. Participants are solely responsible for ensuring that they possess valid and appropriate travel documentation for the entire duration of the tour.

21.2. This includes a valid passport, necessary visas, and any other required travel permits or certificates.

21.3. Golf Flyers Limited is not liable for any consequences arising from participants’ failure to obtain or maintain the required travel documentation. In such cases, no refunds or compensation will be provided.

22. Behaviour:

22.1. Participants are expected to conduct themselves in a manner that is respectful, considerate, and in adherence to local customs and regulations.

22.2. Disruptive, disrespectful, or inappropriate behaviour, including but not limited to harassment, intoxication, or vandalism, will not be tolerated.

22.3. Golf Flyers Limited reserves the right to address behavioural issues with appropriate measures, including warnings, fines, or expulsion from the tour, without any refund.

23. Hotel and Service Conduct:

23.1. When you make a booking with Golf Flyers Limited, you automatically accept responsibility for any damage or loss caused by you or any member of your party during your stay.

23.2. Full payment for any such damage or loss must be settled directly with the hotel or relevant service provider at the time of occurrence.

23.3. Failure to make prompt payment will render you responsible for meeting any claims subsequently made against Golf Flyers Limited. This includes our own and the other party’s full legal costs resulting from your actions.

23.4. We expect all clients to demonstrate consideration for others during their stay. If, in our reasonable opinion or that of any other person in authority, you or any member of your party behaves in a way likely to cause danger, upset, or distress to any third party or poses a risk of damage to property, we or the supplier in question are entitled, without prior notice, to terminate your stay. In such situations, the individuals involved will be required to leave the hotel or other service immediately. Neither Golf Flyers Limited nor the supplier will have any further responsibility towards such individuals, including any return travel arrangements. No refunds will be made, and we will not cover any expenses or costs incurred as a result of the termination.

24. Governing Law and Jurisdiction:

24.1. These terms and conditions are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms will be subject to the exclusive jurisdiction of the courts in England and Wales. If you live in Northern Ireland or Scotland, you may opt for the courts of Northern Ireland or Scotland (as appropriate) to deal with any dispute.

25. Winter Golf and Inclement Weather Policies:

25.1. Golf played on temporary greens and tees during winter golf seasons is non-refundable and considered an accepted aspect of the golfing experience.

25.2. Trolley and buggy bans, implemented based on wet course conditions, are determined by golf course authorities and are beyond the control of Golf Flyers Limited.

25.3. In the event of a golf course closure due to inclement weather, Golf Flyers Limited will, without guarantee, seek a partial refund or green fee vouchers for the golf element of the trip.

25.4. Participants acknowledge that any refunds obtained may not be equivalent to the full green fee, considering the discounted nature of winter breaks.

25.5. The golf element of certain breaks and tours may be included or considered complementary, influencing the potential for refunds.

25.6. Policies regarding inclement weather, closures, and refunds are set by each hotel and golf course, and decisions on partial refunds or green fee vouchers are solely at their discretion and deemed final.

25.7. Participants booking a golf holiday with Golf Flyers Limited acknowledge and accept these conditions regarding winter golf, trolley and buggy bans, and the potential impact of inclement weather on the golfing experience. It is recommended to familiarize oneself with the policies of individual golf courses and hotels regarding these matters.

26. Group Bookings – Lead Name Responsibilities:

26.1. For group bookings, the individual designated as the lead name, aged 18 years or older, assumes specific responsibilities on behalf of the entire group.

26.2. The lead name is responsible for communicating all relevant information, including these terms and conditions, to all participants within the group.

26.3. Any changes, requests, or inquiries related to the group booking should be communicated through the lead name to ensure clear and organized correspondence.

26.4. The lead name is accountable for providing accurate details during the booking process and ensuring that all participants comply with the terms and conditions outlined by Golf Flyers Limited.

26.5. Golf Flyers Limited will primarily liaise with the lead name for matters concerning the group booking, and the lead name should act as the main point of contact between the group and Golf Flyers Limited.

26.6. It is the lead name’s responsibility to disseminate any updates, changes, or additional information provided by Golf Flyers Limited to the rest of the group.

26.7. The lead name, by accepting the role, explicitly acknowledges and accepts the terms and conditions on behalf of all individuals included in the group booking.

26.8. Any breach of the terms and conditions by individuals within the group may impact the lead name’s liability and responsibility for the entire group.

27. Golf Etiquette: 

27.1. Understanding golf etiquette and adhering to the rules of golf is a fundamental expectation for all individuals within your group. Certain golf courses may stipulate the necessity of handicap certificates for visiting players, and we will make every effort to inform you of such requirements during the booking process. However, it is your responsibility to verify, prior to confirming your reservation, whether handicap certificates are obligatory. If required, ensure that each member of your group can meet the specified criteria and possesses the necessary documentation as proof.

28. Complaints, Disputes, and Resolution:

28.1. In the event of any aspect of your holiday falling short of your expectations, kindly notify both us (using the contact details outlined in paragraph 29 below) and the pertinent Supplier Principal, such as your hotelier, immediately. Both parties will make diligent efforts to address and resolve the issue promptly. It is crucial to inform both us and the Supplier Principal to facilitate swift corrective actions. Resolving concerns promptly enhances the overall enjoyment of your holiday. If, however, your complaint remains unresolved locally, please follow up within 28 days of your return home by sending an email to the details specified in paragraph 29 below. Include your booking reference and all pertinent information, maintaining brevity and clarity in your communication.

28.2. Upon receipt of your letter, we will promptly acknowledge it within 14 days, providing a comprehensive response within 28 days, unless an extension is necessary. If unforeseen circumstances impede the investigation within this timeframe, a detailed explanation for the delay will be furnished, with a full reply sent within 56 days. It is imperative to adhere to the timelines outlined in this paragraph, as no liability can be accepted for complaints or claims not notified in accordance with these provisions.

28.4. Additionally, you have the option to utilize the European Commission Online Dispute Resolution (ODR) platform, accessible at http://ec.europa.eu/consumers/odr/. This platform serves as a method for registering your complaint with us; however, it does not determine the resolution process for your complaint.

28.5. Please be aware that failure to communicate problems while on holiday, as described above, denies both us and the suppliers the opportunity to investigate and rectify your complaint in the resort. This may impact your rights under this contract, potentially resulting in a reduction of any due compensation, potentially to zero.
